This document is provided for convenience and transparency. It is a template, not legal advice, and the organization's legal counsel should review and finalize it before launch.
1. Acceptance of these terms
These Terms of Use ("Terms") govern your access to and use of the website at www.scbhc.org and its subpages (the "Site"), operated by Starr County Behavioral Health Center, Inc. ("SCBHC," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
2. About the organization
Starr County Behavioral Health Center, Inc. has filed for incorporation as a Texas nonprofit corporation. We intend to apply for 501(c)(3) federal tax-exempt status; that application has not yet been submitted to the Internal Revenue Service. Because the organization is not a 501(c)(3) and has not yet applied for tax-exempt status, we make no representation that contributions are tax-deductible, and donations are not tax-deductible at this time. The Center described on this Site is being built and is not yet open; it does not provide, and this Site does not offer, clinical, medical, or emergency services.
3. Not medical advice, and not a crisis service
The Site is informational only. Nothing on the Site is medical, psychological, clinical, or professional advice, and no content on the Site creates a provider–patient or therapeutic relationship. The Site is not a crisis or emergency service and cannot respond to a crisis.
If you or someone else is in crisis or immediate danger, do not rely on this Site. Call or text 988 (the Suicide & Crisis Lifeline; Spanish available), or call 911 for emergencies. 4. Website use and acceptable use
You may use the Site for lawful, personal, and non-commercial purposes consistent with these Terms. You agree not to:
- use the Site in any way that violates any applicable law or regulation;
- submit false, misleading, or impersonating information, or claim to be another person or organization;
- interfere with, disrupt, probe, or attempt to gain unauthorized access to the Site, its servers, or related systems;
- introduce viruses, malware, or other harmful code, or use bots, scrapers, or automated means to collect data or submit forms;
- use the Site to send spam or to harvest contact information; or
- use any content from the Site in a way not permitted by Section 5.
5. Intellectual property
The Site and its content — including text, graphics, layout, and the Starr County Behavioral Health Center name, logo, star mark, and other trademarks and brand elements — are owned by or licensed to SCBHC and are protected by intellectual-property laws. You may view and share links to the Site, and you may share our public materials for non-commercial, informational purposes with attribution. You may not copy, modify, distribute, sell, or use our name, logo, or marks to imply endorsement or affiliation without our prior written permission.
6. Your submissions
When you contact us or add your support through a form on the Site, you may provide information such as your name, email, city or ZIP code, role, organization, and an optional message or testimonial. You are responsible for what you submit, and you represent that it is truthful and that you have the right to share it.
We review submissions before any public display. Nothing you submit is published automatically. Your name or story is shown publicly only if you expressly opt in, and we may decline, edit for length, or remove any submission at our discretion. Do not submit health information or another person's personal information. How we handle what you share is described in our Privacy Policy. By submitting content you grant us permission to use it for the purposes, and subject to the consent choices, described there.
7. Third-party links
The Site may link to third-party websites and resources — including crisis lines and partner contact routes — for your convenience. We do not control and are not responsible for the content, policies, or availability of those third parties, and a link is not an endorsement. Your use of a third-party site is governed by that site's own terms and policies.
8. Disclaimers
The Site and all content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any information on it is complete or current. Any reliance you place on the Site is at your own risk.
9. Limitation of liability
To the fullest extent permitted by law, SCBHC and its directors, officers, staff, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Site — even if we have been advised of the possibility of such damages. To the extent any liability cannot be excluded, it is limited to the greatest extent permitted by applicable law. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless SCBHC and its directors, officers, staff, volunteers, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your use of the Site, your submissions, or your violation of these Terms or of any law or the rights of a third party.
11. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and post the new version here. Changes take effect when posted, and your continued use of the Site after they are posted means you accept them.
12. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Starr County, Texas, and you consent to the personal jurisdiction of those courts.
